1. Acceptance of Terms

Welcome to Polka Dots Designer Studio ("Polka Dots", "we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of our website at polkadots.studio, our mobile applications, and all related services, features, and content (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules applicable to specific services. If you do not agree with any part of these Terms, you must not use our Platform.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. Account Registration

To access certain features of the Platform, you must register for an account. By registering, you agree that:

• You are at least 18 years of age, or have parental/guardian consent if you are between 13-18 years old.
• All registration information you provide is accurate, current, and complete.
• You will maintain and promptly update your account information to keep it accurate.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You will immediately notify us of any unauthorized use of your account.
• We reserve the right to suspend or terminate your account at our discretion for violation of these Terms or for any reason deemed necessary to protect the Platform and its users.

3. Orders and Purchases

3.1 Placing Orders

When you place an order through our Platform, you are making an offer to purchase the selected products or services. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for reasons including but not limited to:

• Product unavailability or stock errors.
• Pricing errors or inaccuracies.
• Suspected fraudulent or unauthorized activity.
• Verification failure for payment or identity.
• Delivery limitations to the specified address.

3.2 Order Confirmation

An order confirmation email does not constitute acceptance of your order. Acceptance occurs only when we dispatch the product or confirm the commencement of a custom/DressForge order. We may contact you for additional verification before processing high-value orders.

3.3 Order Modification and Cancellation

You may modify or cancel a standard order within 2 hours of placement, provided it has not entered the "Processing" stage. Custom-made and DressForge orders may be cancelled before fabric cutting or work commencement. Cancellation after work has begun may result in partial charges. Contact our support team for any modifications.

4. Pricing

All prices displayed on our Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. We make every effort to ensure pricing accuracy, but errors may occur. If a pricing error is discovered after you place an order, we will notify you and offer you the option to proceed at the correct price or cancel the order for a full refund.

We reserve the right to change prices at any time without prior notice. Price changes do not affect orders that have already been confirmed and accepted. Promotional prices and discount codes are valid only for the duration specified and subject to their respective terms.

5. Payments

We accept the following payment methods:

• UPI (Google Pay, PhonePe, Paytm, and other UPI apps).
• Credit and Debit Cards (Visa, Mastercard, RuPay, American Express).
• Net Banking from all major Indian banks.
• Mobile Wallets (Paytm Wallet, Amazon Pay, etc.).
• Cash on Delivery (COD) for orders under Rs. 5,000, subject to availability at your location.
• EMI options on select credit cards for orders above Rs. 3,000.

All payment transactions are processed through RBI-compliant, PCI-DSS certified payment gateways. We do not store your full credit/debit card details on our servers. By providing payment information, you represent that you are authorized to use the payment method.

6. Shipping and Delivery

We ship to addresses across India. Estimated delivery timelines are provided at checkout and are not guaranteed. Actual delivery times may vary due to factors beyond our control including weather, logistics delays, and regional disruptions.

Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not liable for delays or damages caused by the shipping carrier, although all shipments are insured for your protection. Please refer to our Shipping Policy for complete details.

7. Returns and Refunds

Our return policy allows for returns of eligible products within 7 days of delivery, subject to the conditions outlined in our Return & Refund Policy. Custom-made products, DressForge orders, altered items, and certain categories are not eligible for returns.

Refunds are processed to the original payment method within 3-5 business days of receiving and inspecting the returned item. We reserve the right to reject returns that do not meet our return conditions.

8. Marketplace Terms

The Polka Dots Bazaar marketplace hosts products from verified third-party vendors. When purchasing from marketplace vendors:

• The contract of sale is between you and the vendor. Polka Dots acts as a facilitator.
• All marketplace products are covered by our standard return and quality policies.
• The Polka Dots Buyer Protection guarantee applies to all marketplace purchases.
• We reserve the right to mediate disputes between buyers and vendors.
• Vendors are independent entities and their views do not represent Polka Dots.

9. DressForge Terms

DressForge orders are custom-made to your specifications. By placing a DressForge order, you acknowledge that: (a) the final product may have minor variations from reference images; (b) you are responsible for providing accurate measurements and design specifications; (c) stage approvals are final once confirmed; (d) DressForge orders are not eligible for standard returns unless there is a significant quality defect or deviation from your approved design; (e) timelines are estimates and may vary based on complexity and artisan availability.

10. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, product designs, software, and the Polka Dots brand identity, is the property of Polka Dots Designer Studio or its licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our prior written consent.

By submitting content to our Platform (reviews, gallery photos, feedback), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce such content for our business purposes, including marketing and promotional materials.

11. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Post false, misleading, defamatory, or offensive content.
• Interfere with or disrupt the Platform or its infrastructure.
• Attempt to gain unauthorized access to any part of the Platform.
• Use automated scripts, bots, or scrapers to access the Platform.
• Impersonate any person or entity.
• Engage in fraudulent transactions or abuse promotional offers.
• Harass, abuse, or harm other users or our staff.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Polka Dots Designer Studio and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Platform.

Our total liability for any claim arising from your use of the Platform shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the liability.

13. Indemnification

You agree to indemnify, defend, and hold harmless Polka Dots Designer Studio, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through amicable negotiation. If the dispute cannot be resolved within 30 days of the initial notice, it shall be referred to and resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The arbitration shall be conducted in Chennai, Tamil Nadu, India, in English, by a sole arbitrator mutually appointed by the parties.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts of Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or your use of the Platform.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
